360 Interactive Virtual Tours
1. Introduction
Any client that uses either a service or product supplied by Timeless Retreats
is legally bound by the following terms and conditions of business unless
otherwise specifically agreed in writing. Timeless Retreats reserves the
right to amend the Terms and Conditions at any point. Any changes will be
posted
on the www.timelessretreats.co.uk website. It is the client’s responsibility
to review the terms and conditions at regular intervals.
2. Awareness
The client is aware that virtual tours need third party software to be installed
on a computer for the tour to be viewed and that Timeless Retreats create
virtual tours that need either QuickTime or Java to be installed on a computer
for
the tour to work correctly. The client is also aware that Timeless Retreats
virtual tours are made up of panoramic images. These images can be over 200kbs
each and the Timeless Retreats virtual tours are best viewed using a Broadband
Internet connection.
3. Photographic brief and quotation
Timeless Retreats will require a clear brief before a written quotation is
submitted to the client. Timeless Retreats will not commence any photographic
commission
until a price has been agreed, a written order has been received and a deposit
has been paid. (Please see section 11. Payment Terms)
It is the client’s responsibility to acquire any permission that may
be required and that the site is ready and presented as the client wishes it
to be viewed in the Virtual Tour upon the arrival of Timeless Retreats photographer.
The brief is essential in order to establish the exact objectives of the photographic
session and to ensure that the site or subject to be photographed is with full
permission and has been fully prepared in accordance with section 4. of these
terms and conditions. If a site survey is required, the cost shall be agreed
and paid prior to the commission taking place. Unless otherwise stated, the
quotation shall only include the photographs being supplied in digital JPEG
format via e-mail or sent on CD-ROM. Virtual 4 Media shall use the equipment
and methods it sees fit to take the photographs in accordance with your proposed
use of the images in the brief. Timeless Retreats reserves the right
to reject any commission.
4. Photographic Permission
You shall be responsible for obtaining all relevant permission’s prior
to Timeless Retreats arriving on site to carry out the commission. These permission’s
shall include legal access, authority to take the commission from the owner
and / or the police and / or local authority authorization where required.
In some public places or when taking aerial photographs, a licence or police
authority may be required which, shall be your responsibility. If all relevant
permission and access is not obtained when Timeless Retreats arrives on site,
you shall be liable for the full cost of the commission. Timeless Retreats
has the right to make the final judgment on whether the site is suitable and
safe
for the photographic commission.
5. The Commission
Once Timeless Retreats has received a written order, the commission will take
place at the agreed place, date, time and for the quoted price unless instructed
in writing by either party. Any notice of cancellation less than 14 days
prior to the agreed time shall be charged at 80% of the invoice value. All
cancellations
shall be in writing. You shall be responsible for obtaining all permission
and preparing the site or subject for photography prior toTimeless Retreats
arriving on site, unless otherwise agreed in writing. If you or Timeless
Retreats are unsure about the feasibility of photographing at the location,
a site survey can be arranged at an agreed fee. Once on site, Timeless Retreats
reserves the right to invoice you at the full rate whether or not the commission
is completed, unless a prior arrangement has been reached in writing. You
will also be invoiced for the full amount if Timeless Retreats arrives at
the location but cannot obtain access to the site.
6. Copyright
Timeless Retreats retain full, unlimited, worldwide copyright and intellectual
property rights of all photographic material and resulting images from a
commission. These virtual tours are solely for display purposes and you are
prohibited to alter any material supplied by Timeless Retreats without first
receiving written permission from Timeless Retreats. They may not be copied,
published, reproduced, or stored on any electronic retrieval system without
the express written permission of Timeless Retreats. Timeless Retreats’s
exclusive copyright of the photographic images supplied allows Timeless Retreats
to use any of the images for any purpose unless otherwise agreed in writing.
7. Portfolio
Timeless Retreats have the right to show work created for the client(s) on
Timeless Retreats and Virtual 4 Media’s website(s). The client agrees
to their logo being displayed and a web link to the clients website where
applicable.
8. Failure
Whilst every care is taken at every stage of the photographic process, in the
event of a camera failure, operator error, material failure, loss, theft
or machine failure, Timeless Retreats can accept no responsibility for any
losses however incurred as a result of any such failure beyond a full refund
of the original purchase price.
9. Liabilities
Timeless Retreats endeavours to carry out the commission as stated in the agreed
brief. Whether the commission is or is not completed, Timeless Retreats shall
be limited to the fees agreed in the quotation for the specific job, not
any resulting losses or damages.
10. General Liability
Timeless Retreats can accept no contingent liability for any failure of any
type resulting from the failure in any way of any product or service they
supply.
11. Payment Terms
Timeless Retreats will carry out a commission based upon a written order. A
booking will only be confirmed once a deposit of 50% has been received unless
otherwise stated. The balance payable before any images or virtual tour is
released from Timeless Retreats unless a prior payment arrangement has been
agreed in
writing. If a
payment is not settled within 14 days of invoice date, Timeless Retreats
reserves the right to charge interest at 5% per month. Timeless Retreats
reserves the
right to retain all material supplied until payment is received in full.
12. Logo
Unless otherwise stated the Timeless Retreats logo will appear on the bottom
of all 360° virtual tour viewers and on the tour itself along with a
clickable link to the Timeless Retreats web site.
13. Weather
Timeless Retreats cannot be held responsible for the weather. If weather conditions
do not permit outside / external scenes to be shot on the allocated date
then Timeless Retreats will at it's own discretion and convenience return
on an alternative date to shoot exterior scenes. Internal scenes will be
produced regardless of weather conditions. In less favourable weather conditions
Timeless Retreats cannot be held responsible for the quantity or quality
of any scenes that are produced. In this situation the invoice will
still need to be paid for
in full before the release of any images or advertising on the
Timeless Retreats website.
Clients located more than 40 miles from the
Virtual 4 Media office will have the option to re-schedule the
whole commission. If the client wishes to proceed regardless
of weather conditions then Virtual 4 Media accepts no responsibility
for the quantity or quality of any outside scenes that are produced.
In this situation the invoice will still need to be paid for
in full before the release of any images and any return visit
will be charged for accordingly.
14. Client Satisfaction
In any circumstances where you are not completely satisfied with the photographic
quality or services provided, Timeless Retreats will have the final say in
the arrangement of a satisfactory outcome. Timeless Retreats will not be
liable for any financial refund but will, at its discretion redo the commission.
Property Advertising
· Application
All applications to advertise properties on www.timelessretreats.co.uk
must be submitted stating all required information in English.
We reserve the right to reject or amend any property advertisement
submitted to Timeless Retreats Limited at our sole discretion,
both in order to enhance your advertisement and also to adhere
to the general format of www.timelessretreats.co.uk as a whole.
All properties will be indexed according to the number of bedrooms
the property contains. Timeless Retreats Limited does not classify
mezzanines as a bedroom unless they are fully enclosed. Bedrooms,
which are accessed via another bedroom, should be clearly indicated
in your text.
· Photographs
All photographs must be original and in full colour or digital
images. Photocopies or composite photos made from more than
one image cannot be accepted. Digital images or self-scanned
pictures should not be less than 235 pixels high. Digital images
saved in jpg format must be saved with the quality level
set for best quality (usually 10 or 12). Any photographs submitted
by post
please
make sure that any captions that are
written on the reverse of photographs are completely dry and
preferably separated with a sheet of paper before posting to
minimise any damage.
· Uploading your Advertisement
Once we have compiled your advertisement and your property
is ready to be uploaded onto the www.timelessretreats.co.uk
web site we will send you confirmation that your property is
ready to go online and ask you to check that all the details
are correct. It is the owner's responsibility to check that
all details in the advertisement are correct and any changes
must be highlighted to Timeless Retreats Limited. Any changes
made will be sent to you once again to be checked. Once all
amendments are resolved Timeless Retreats Limited request your
written approval before we will upload your property onto www.timelessretreats.co.uk.
Any changes made to property details once they have been uploaded
will incur a charge as detailed in our price list. Full payment
must be received before changes are made.
Once your advertisement has been submitted, edited, compiled
and uploaded onto www.timelessretreats.co.uk, it becomes the
property of Timeless Retreats Limited and may not be copied
from the web site without written permission. Submitted photographs
may be used in promotions or in any other areas of the site.
You may not give permission for other websites to copy material
from Timeless Retreats Limited.
· Email
Timeless Retreats Limited will not display email addresses
directly on your web page but instead include an email form.
This is in order to protect your email address from receiving
spam and virus attachments. It is the property owner’s
responsibility from the time your advertisement is uploaded
to regularly check that this email form is working and inform
us of any problems you may encounter. Timeless Retreats Limited
cannot guarantee that all email enquiries will be received
by property owners due to external circumstances outside of
our control such as ISP spam filtering. You can change your
contact email address at any time by contacting Timeless Retreats
Limited directly. Inappropriate use of the email form on other
property owner’s pages is forbidden and may result in
the suspension of your advertisement without notice.
· Changes to your property details
During your subscription period any minor changes to text
i.e.; prices, rental dates and contact details can be made
at any time by writing or sending an email (stating in your
correspondence your name and property reference number) to
Timeless Retreats Limited. These changes will be made free
of charge. Upon renewal of your advertisement subscription
any changes to your property details or photographs can be
made free of charge. These amendments will only be made upon
full payment for the new subscription period and will only
be uploaded again once we have received your written approval.
· Property owners responsibilities
The property owner agrees to:
Maintain their properties availability page by updating their
page with all weeks that become booked as soon as they become
sold. Any complaints received by Timeless Retreats Limited
stating that the availability is consistently incorrect then
your property may be suspended without notice. If you do not
enter your availability you will exclude the property from
appearing in any data based search results.
Inform Timeless Retreats Limited via email of any update in
their rental prices as appropriate. If rental prices are not
displayed on your advertisement then this will result in your
property being excluded from any price based search results.
Inform Timeless Retreats Limited of any changes to contact
details
Familiarise themselves with the current terms and conditions
each time you visit the website. By using or continuing to
use the services of Timeless Retreats Limited, you agree to
the terms and conditions stated.
· Properties of the week
Timeless Retreats Limited will provide each property with
two free entries consisting of two weeks in duration in the
featured properties of the week section on www.timelessretreats.co.uk
. Additional entries may be purchased at any time by contacting
Timeless Retreats Limited.
· Links
Links to a personal website can be added, providing the personal
site does not advertise material which is not advertised on
Timeless Retreats, is not commercial in any way and does not
contain links to other web sites. Timeless Retreats reserve
the right to withdraw a link without notice if the linked site
is found to be in breach of this condition. Links to other
sites will not be included.
In the future rental clients and property owners will be able
to benefit from discounted travel rates offered through Timeless
Retreats Limited and a link will be included on your page to
inform future rental clients of this or any other service that
we may offer in future.
· Payment
To secure your virtual tour booking we require a 50% deposit
in Pounds Sterling, with the outstanding balance paid prior
to your virtual tour being uploaded onto www.timelessretreats.co.uk.
The cost for advertising each property on www.timelessretreats.co.uk
is for one year and
includes initial set-up and a site visit. At present all
payments must be made by cheque and must be paid in pounds
sterling and drawn from a UK
bank account
being made payable to Timeless Retreats Limited.
· Refunds
Due to the amount of time and organisation required to come
and visit your property and produce the virtual tour, refunds
can only be given for cancelled appointments if we are given
30 days notice before your booked date. Once the virtual tour
has been produced or any other work has commenced on preparing
your property to be included on
www.timelessretreats.co.uk
we are
unable
to
offer
a refund
on cancelled subscriptions no matter what the reason. This
is due to the large amount of work involved in setting up and
promoting your property in the initial few weeks of your subscription.
If the property is sold during your subscription period we
will transfer your subscription to the new owner for a small
fee. Refunds can only be made if the advertisement is cancelled
before any work has commenced and then only at the discretion
of Timeless Retreats Limited.
· Renewal
Your renewal date will be 12months after your property details
have been uploaded onto www.timelessretreats.co.uk. An email
inviting renewal of your advertisement will be sent to
you
in the month
prior
to
this
expiry date. All renewal payments must be received on or before
the stated renewal date otherwise the property will be automatically
removed from the www.timelessretreats.co.uk . In order to avoid
any unnecessary advertisement downtime we request that all
renewal payments are made 7 days prior to your renewal date
to allow for payment processing through the bank. If renewal
payments are not received and your advertisement is removed
you may still reinstate your advertisement with 30 days of
the renewal date at the renewal fee. Thereafter your invoice
will be cancelled and current rates will be applied.
· Complaints
In the unlikely event that Timeless Retreats Limited should
receive 2 complaints pertaining to the same nature about your
property Timeless Retreats Limited reserves the right to suspend
the advertisement pending investigation. If the complaints
are found to be justified the advertisement will be terminated.
No refund will be given in this event.
· Website changes
Timeless Retreats Limited reserve the right to make amendments
to, or upgrade its' website www.timelessretreats.co.uk as the
Company feels appropriate. This includes changes to our search
criteria, which may be updated at any point during the year,
and changes to the format on the home page and all other pages
on the site including individual advertisements.
· Changes to Terms and Conditions
Timeless Retreats Limited may at any time vary and amend its
terms and conditions by publishing the varied Terms and Conditions
on www.timelessretreats.co.uk . You accept that by doing this,
Timeless Retreats Limited has provided you with sufficient
notice of the variation and amendment. Timeless Retreats Limited
will not be notifying individual clients as and when the variation
occurs.
English Law shall apply to these terms, notwithstanding the
jurisdiction where you are based. You irrevocably agree that
the courts of England shall have exclusive jurisdiction to
settle any dispute which may arise out of, under, or in connection
with these terms and for those purposes irrevocably submit
all disputes to the jurisdiction of the English courts. The
place of performance shall be England.
We hope you will be pleased with the presentation of your
property details, the quality of our website and the interest
and bookings that your advertisement will generate. We endeavour
to provide a personal, professional and cost-effective service.
